6. If the Seller, at any time including after development of the contract, considers the credit of the Buyer unsatisfactory the Seller might: (a) need security for payment of the Purchase Price. 13. 14. It is normal procedure to bolt racking structures to the floor, and unless otherwise, our quotation makes allowance for this. Nevertheless, if the flooring slab is enhanced with grid steel mesh or similar materials to a level less than 70 mm listed below the surface, special drilling devices will be needed and any additional expenses incurred will be to the buyer's account.
Unless mentioned in writing our quote assumes a sensible condition of flatness of floor. Flatness tolerances should be within + 3 mm inside a 3 metre radius. Additional expenses incurred in compensating for a faulty or unequal flooring will be to the purchaser's account. 19. We book the right to appoint or subcontract out the entire or any part of this agreement at our discretion.
At any times quoted for our completion or delivery work from the date of invoice by us of a written order to proceed, together with all details and particulars we need to continue with the manufacture without interruption or delay. All such times are to be treated as estimates only and we shall not be responsible for failure to dispatch, set up, or otherwise perform within such times unless otherwise concurred in writing.
21. The Buyer shall pay the Seller instantly. If the Buyer stops working to make a payment by the due date, the Seller may, without notification, keep shipment of any further Item to the Buyer and might end, without liability to the Purchaser, any or all surviving agreements between the Seller and the Buyer.
If payment is not made on the due date, the Seller may charge interest on the amount payable at the rate of 5% over the 90 day bank costs rate relevant on the day the payment is due. 23. The Purchase Cost is not inclusive of products and services tax, unless otherwise specified in composing.
